GENERAL TERMS AND CONDITIONS OF SALE – PROFESSIONAL CUSTOMERS (B2B)
Preamble
These General Terms and Conditions of Sale (hereinafter the “GTC”) govern exclusively the sale of products concluded between MOJO CONNECTION SAS and any professional customer acting within the scope of its commercial, industrial, artisanal or liberal activity (hereinafter the “Customer”).
Any order implies full and unconditional acceptance of these GTC, to the exclusion of any other document issued by the Customer, unless otherwise expressly agreed in writing by MOJO CONNECTION.
1. Seller Identification

2. Products
The essential characteristics of the products are described on the website and commercial materials. Visuals, photographs and descriptions are provided for information purposes only and do not constitute contractual elements.
MOJO CONNECTION reserves the right to make any technical or aesthetic modifications intended to improve product quality.
3. Quotations – Orders
Any order becomes final and binding upon receipt of a signed quotation or written validation of the order.
MOJO CONNECTION reserves the right to refuse any order in the event of a previous dispute or non-compliance with payment terms.
Where applicable, a minimum order amount and/or free-shipping conditions may apply. Such conditions are indicated on the website or communicated to the Customer upon request.
4. Prices
Prices are expressed in euros, exclusive of taxes (excl. VAT). Delivery, handling or specific costs are invoiced in addition.
Prices may be revised at any time. The applicable price is that stated on the quotation or order confirmation.
5. Payment Terms
Unless expressly agreed otherwise in writing by MOJO CONNECTION, payment is due at the time of order and prior to shipment of the goods.
Any specific payment terms granted to the Customer must be confirmed in writing and shall prevail over these GTC.
In accordance with Article L441-10 of the French Commercial Code, any late payment shall automatically result in:
late payment penalties calculated on the basis of the European Central Bank refinancing rate plus ten (10) percentage points;
a fixed compensation for recovery costs of €40.
6. Delivery
Delivery times are provided for information purposes only. Any delay shall not give rise to penalties or order cancellation.
The transfer of risks occurs upon handover of the products to the carrier.
7. Retention of Title
In accordance with Article 2367 of the French Civil Code, MOJO CONNECTION retains ownership of the products until full payment of the price has been received.
8. Claims
Any claim relating to an apparent defect or non-conformity must be made in writing within five (5) business days following receipt of the products.
9. Commercial and Legal Warranties
Products benefit from any commercial warranties expressly stated on the relevant product data sheets or contractual documents.
In all cases, statutory warranties applicable between professionals remain applicable.
10. Liability
MOJO CONNECTION’s liability is strictly limited to the amount excluding VAT of the relevant order.
MOJO CONNECTION shall not be held liable for indirect damages such as loss of business, loss of turnover or loss of data.
11. Personal Data
Personal data is processed in accordance with the General Data Protection Regulation (GDPR). Full details are provided in the privacy policy.
12. Governing Law – Jurisdiction
These GTC are governed by French law.
Any dispute relating to their interpretation or execution shall fall under the exclusive jurisdiction of the Commercial Court of Nantes, including in the event of multiple defendants or third-party claims.
